1/3 This bill sets out specific roles and responsibilities for psychiatrists. One of the determining factors detailed in section 3(2) is that the person is not suffering from any mental disorder which might affect decision making (section 3(2)(a).

2/3 In this section, “mental disorder” has the same meaning as it has in section 328 of the Mental Health (Care and Treatment) (Scotland) Act 2003), namely any mental illness, personality disorder, or learning disability, however caused or manifested.
