Sotomayor has invited the lower courts to revisit the constitutional question (for the third? fourth? time) on remand. This, of course, ignores the immense cost that litigating claims like this carry. The Court missed an opportunity to put an end to this nonsense.

It still is not the end of Mckesson's First Amendment defense, as Justice Sotomayor explained, the Court made clear in Counterman (just days after the Mckesson case) that imposition of liability on the basis of expression absent a heightened mens rea is likely unconstitutional.

McKesson denied. Totally wild.
