Requirements for one to enter into a civil marriage are that the person be above the age of 18, not married to any other person, submission of identity documents, payment of a nominal fee and personal appearance with two witnesses.

A civil partnership may include a party whom is married to other person in terms of civil marriage. The property rights of the spouse are protected and will not be infringed in any manner by the civil partner. The rights of the civil partner further do not extend to inheritance.

Civil partnerships involve parties in the unions that fall into a gray area that isn’t marriage or recognizable at law as such. The parties in these unions must be together in a genuine domestic basis to have property rights recognized at the dissolution of the relationship.
