When Cosby was put on trial the judge also allowed the DA to introduce testimony from accusers who were not involved in the case.
But in that case the appeals court didn't bother to consider that fact. It was the illegal introduction of the civil deposition that freed Cosby.

His privilege took a little bit to kick in but his New York conviction has been overturned, clearing the way for a new trial. The appeals court said the judge erred when he let the DA introduce testimony from other accusers not involved in the case.
