Thank you to Verfassungsblog for posting my comments on yesterday’s very concise #ICJ decision on provisional measures in #Nicaragua v #Germany . I even talk about plausibility.

Not unexpectedly (see below), the #ICJ has indeed rejected (15-1) #Nicaragua 's request for PMs. The decision largely reiterates #Germany 's arguments on the facts. Nicaragua was not able to show that Germany's actions are creating the risk of irreparable harm that it alleged.

According to the order, “The court concludes that, at present, the circumstances are not such” to indicate provisional measures. On the matter of jurisdiction, the court will not strike the case from the record, as Germany requested.

The 'Schland is in The Hague as the ICJ convenes to deliver its order that could find Germany in breach of its international obligations as they concern the Genocide Convention, due to its support for Israel.
